ADULT WAIVER

Agreement with Hammersmith Martial Arts Club

I understand the risks of training in the martial arts taught at this club and confirm that I voluntarily choose to participate. I acknowledge that Brazilian Jiu-Jitsu, Wrestling, Judo, K1 Kickboxing, MMA, strength training and all related activities are full-contact and physically demanding activities in which injuries are common.

I understand that managing my safety, training responsibly, and communicating with training partners and instructors is part of my responsibility as a participant.

I understand that participation in full contact training may expose me to viruses, illness, or other communicable conditions. I knowingly and voluntarily accept these risks to myself and to those I live or interact with.

I confirm that I will not train when I am unwell, injured in a way that makes training unsafe, or under the influence of alcohol or drugs.

I understand that if I have any pre-existing injuries, medical conditions, or health concerns that may affect my ability to train safely, I must inform the club and instructors. I accept that training may worsen existing conditions and I take responsibility for managing my training accordingly.

I understand that participation in martial arts training carries the risk of serious injury and, in rare cases, death. I voluntarily accept these risks.

Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence to the extent that such liability cannot be excluded under UK law. However, to the fullest extent permitted by law, I agree to the terms set out below.

MEMBERSHIP CANCELLATION NOTICE

I understand that membership is ongoing and will continue until cancelled.

If I wish to cancel my membership, I agree to provide a minimum of one calendar month’s notice in writing.

Membership fees remain payable during the notice period.

STATEMENT OF MEDICAL FITNESS

I confirm that I am physically and mentally fit to participate in martial arts training and physical exercise, or that I have sought appropriate medical advice and choose to participate regardless.

I agree that:

• I will inform instructors of any relevant injuries or medical conditions

• I will take responsibility for managing my own health and limitations

• I will not train while under the influence of alcohol or non-prescribed drugs

• If I am pregnant, or become pregnant, I will inform the club and take full responsibility for my participation decisions

I confirm that the information I provide to the club is accurate to the best of my knowledge.

AGREEMENT, RELEASE OF LIABILITY & ASSUMPTION OF RISK

In consideration for being permitted to use the facilities and participate in martial arts training conducted by Hammersmith Martial Arts Club and any associated entities, I agree as follows:

PARTIES INCLUDED

This agreement applies to Hammersmith Martial Arts Club and any associated entities, including instructors, employees, contractors, agents, students, volunteers, and anyone involved in the operation of training, classes, or events (collectively referred to as the “Covered Parties”).

DURATION

This agreement applies to all current and future training sessions, classes, open mats, events, and activities connected with the club, whether on or off the premises.

ASSUMPTION OF RISK

I understand that martial arts training is inherently dangerous and may involve:

• physical contact

• takedowns and throws

• joint locks and chokes

• strikes and grappling

• risk of falls or collisions

• unsupervised open mat training

• equipment use

These risks include, but are not limited to:
broken bones, sprains, concussion, restricted breathing, illness, permanent injury, or death.

I voluntarily accept all inherent risks associated with participation.

OPEN MAT AND UNSUPERVISED TRAINING

I understand that open mat sessions or informal training periods may occur without direct supervision. I accept full responsibility for my participation during such sessions.

RELEASE OF LIABILITY

To the fullest extent permitted by law, I release the Covered Parties from liability for injury, loss, or damage arising from my participation in martial arts training, except where caused by negligence that cannot legally be excluded under UK law.

COVENANT NOT TO SUE

To the fullest extent permitted by law, I agree not to bring claims against the Covered Parties for injuries or losses arising from the inherent risks of martial arts training.

INDEMNITY

I agree to indemnify and hold harmless the Covered Parties from claims arising from my actions, misconduct, or failure to follow club rules while participating in training.

RULES AND CONDUCT

I agree to follow all club rules, safety instructions, and directions from instructors and staff.
I understand that failure to follow rules may result in removal from training or termination of membership.

I accept responsibility for any damage caused by my actions to facilities or equipment and agree to pay reasonable costs for repair or replacement.

MEDIA CONSENT

I understand that training and events may be photographed or recorded for promotional or educational purposes and I consent to such use without compensation.

DATA SHARING

I understand that my details may be shared with relevant governing bodies (such as UKBJJA) where required for membership, grading, or competition purposes.

MEMBERSHIP STATUS AND RIGHT TO TERMINATE

I understand that Hammersmith Martial Arts Club operates as a private members club and that membership is a privilege, not a right.

The Club reserves the absolute right, at its sole discretion and without providing a reason, to:

• refuse membership

• suspend membership

• terminate membership

• remove any person from classes, events, or premises

This may occur where the Club considers it necessary for safety, welfare, conduct, culture, or operational reasons.

I understand and agree that:

• membership may be terminated at any time

• no refund is guaranteed where membership is terminated

• I will comply immediately with any request to leave the premises

• termination does not create liability for the Club or its staff

Any such decision by the Club is final.

ENFORCEABILITY

If any part of this agreement is found unenforceable, all remaining parts shall remain in full effect.

UNDERSTANDING OF AGREEMENT

I confirm that I have read and understood this agreement and that I am signing it voluntarily. I understand that by signing this document I am accepting the risks associated with martial arts training and agreeing to the terms set out above.

I acknowledge that I have the right to seek independent legal advice before signing.

I agree to be bound by this agreement.
